Can a person who has a minority owned business or women owned business (MBE/WBE) still receive W2 from a different business?

Hi all

Could someone kindly provide an answer to my question and also provide me sources where I can look up the information myself? I already know that if I have a MBE / WBE I cannot receive W2 from that business, I’m essentially taxed as a sole proprietor or partner. However, say my MBE is not making enough, can I still work elsewhere and receive a W2 without losing the MBE designation for my business? Thanks in advance.

  1. Employment by another business entity does not change your own business. They can hire you as an employee W-2 or as an independent contractor or vendor and report payments as 1099 Misc.

  2. Yes you can. In fact, if you’re an employee for another Company, they are obligated to tax you and issue you with a W-2
